  1. York Christmas Trees General Terms and Conditions of Sale

 

  1. York Christmas Trees will only sell to customers aged 18 years or over.
  2. By placing an order with York Christmas Trees, you are making an offer to buy and if accepted by us creates a binding contract.
  3. We reserve the right to revise prices and details at any time, but we undertake to guarantee the price at the time of your order being confirmed.
  4. We reserve the right to decline service to any individual or business.
  5. We reserve the right to alter the ordering and delivery terms.
  6. Any issues with a tree or wreath must be raised within 4 days of receipt of goods. After this time, we cannot be held responsible for the local climate and environments impacts on the tree.
  7. Christmas trees, like any other plants or cut flowers are a perishable product and require water to allow them to last as long as possible. Failure to provide sufficient water to your tree may reduce its life and quality.
  8. All items advertised by York Christmas Trees are subject to availability.
  9. The website design, text and images are the copyright of York Christmas Trees unless they have been supplied by other bodies.
  10. Please check your order carefully before submitting it to ensure it is correct as we cannot be held responsible for user error.
  11. We need your name and address to know where to send the order, your card details for payment and your telephone number and e-mail address so we can contact you.
  12. We will keep all the information we collect in a safe and secure way.
  • York Christmas trees uses the latest encryption technology on our secure payment facilities, and we value your privacy. Your details will not be passed to any 3rd party (unless you use PayPal for your payment). However, York Christmas Trees and Cubtec cannot and will not be held responsible for any security breech resulting from DOS (Denial of Service) attacks, viruses, or any other type of unauthorised malicious attack.
  • York Christmas Trees may contact you next Christmas to see if you would like to purchase from us again, if you do not wish us to contact you in the future please tick the box requesting that you should not be included in future communications.
  • We accept payment with major credit cards and debit cards which will be processed through the secure payment service provided by ????
  • The prices shown include VAT and full payment will be taken on order.
  • Funds must be received by us in full prior to despatch of your order.
  • The charge for delivery includes delivery to your door but does not include placing, erection of the tree, removal of packaging or decoration of the tree.

  2. Our trees are natural products grown in a natural environment.
  3. We grade our trees in the field, again prior to cutting and netting and finally at the point of sale to ensure we sell good quality trees.
  4. As natural products all tree and wreath sizes are approximate and shape, density and colour may vary. Due to this natural variation, we will not accept responsibility for any tree not meeting expectation in these respects. However, we do ensure that you will receive a good quality tree.
  • We cannot be held responsible for any deterioration in quality of Norway spruce when used indoors as this is not sold as a needle fast species.
  1. It is the purchaser’s responsibility to return any goods at their expense, please (see our returns policy).
  2. We strongly advise our customers not to collect or take delivery of a tree prior to the 28th November as a tree is a perishable product and its ability to last until Christmas will be severely compromised.
  • Our trees are grown in plantations which are a natural environment with wildlife and so trees may contain spiders or other insects and wildlife.
  1. To ensure our trees are as fresh as possible we harvest right through the selling season in very variable weather, although we try to keep the trees clean and tidy, they pick up mud, contain weeds, ice, water and even birds’ nests. Please be careful when un netting your tree as we cannot be held responsible for any damage caused by such debris falling from the tree.
  2. To help keep your tree fresh and healthy looking please follow the care instructions on the label and on our website.
  • Our trees are specially grown as Christmas trees and are managed to produce the correct shape, this can mean some of the branches are fragile and care should be taken when handling the trees to avoid damage
  1. Our trees are netted prior to leaving our farm to protect them and to make them easier to handle.
  2. Please take care when handling the product, the safe use of the product is your responsibility.
  3. Avoid placing the tree near any sources of direct heat such as radiators, open fires, stoves, or heaters.
  4. When placing trees on heated floors please ensure there is adequate insulation between the tree stand and the floor.
  • All our trees are grown either by ourselves at York Christmas trees or by a small number of specially selected other growers who we work closely with.

 

 

 

  1. York Christmas Trees Delivery Terms and Conditions
  • On receipt of your goods please check it before accepting it and inform the driver of any problems.
  • If the tree has been damaged in transit please inform us by e-mail within 48 hours with photographs of the damage.
  • All deliveries are made to your building only, any service to take the tree into the building or block of flats is at the discretion of the delivery driver.
  • Our delivery service does not include placing of the tree, installation of the tree or removal of packaging.
  • Our products are perishable goods that are cut or prepared to order and in accordance with the UK distance selling regulations we cannot accept cancellations or returns of goods
  • Delivery of goods is available in the locality of York from Monday to Friday on a 72-hour standard delivery service. We will notify you of the scheduled delivery date and whether it is a morning or afternoon delivery.
  • Please ensure you are available to receive the goods on at the scheduled delivery date and time.
  • We cannot guarantee that you will receive your tree on the scheduled day as we offer a delivery service in good faith and cannot accept responsibility if the goods do not arrive on time.
  • If the goods do not arrive on time, we cannot accept cancellation of the order.
  • We normally deliver between 9am and 6pm.
  • You must specify on your order where the goods can be practicably left if you are not in when it is delivered.
  • You are advised to provide details of a safe location that your goods can be easily left in by the delivery driver.
  1. York Christmas Trees cannot accept any responsibility for damage to or theft of goods after delivery.
  2. We cannot guarantee special delivery instructions will be followed as this is at the discretion of the delivery driver.
  • The last date for delivery is Tuesday 22nd December

 

 

 

 

 

 

  1. Cancellation Policy for Non-perishable goods (Excludes Christmas Trees)
  • In accordance with the United Kingdom’s Distance Selling Regulations you have the right to cancel your order within 7 working days beginning from the day following receipt of your order.
  • We require notice of cancellation in writing which may be posted or e-mailed before this period expires. In the event that you wish to cancel your purchase we request that you contact us by e-mail at kirstie@yorkchristmastrees.co.uk at your earliest opportunity.
  • Until the goods are returned it is your responsibility to take reasonable care of them. They should be returned with their original packaging, unused and in saleable condition.
  1. ALL GOODS RETURNED MUST BE ACCOMPANIED BY THE ORIGINAL RECEIPT AS PROOF OF PURCHASE.
  • You are responsible for the cost of return carriage. If the items are faulty or damaged, we will refund any return costs once we receive your goods.
  • If we do not receive the item we will arrange for collection of the item at your expense. On receipt of a cancellation notice, which is in accordance with the above conditions, we will refund the original charge for those items returned.

 

  1. Cancellation Policy for Perishable Goods (Includes Christmas Trees)

 

  • We cannot accept cancellations or returns for perishable goods any later than 5 days before due shipment as trees and wreaths are freshly cut or prepared to order.
  • If you wish to cancel your purchase before this time, we require notice of cancellation in writing which may be posted or e-mailed and upon its receipt we will refund the original charge for those items cancelled.
  1. In the event that you wish to cancel your purchase we request that you contact us by e-mail at kirstie@yorkchristmastrees.co.uk at your earliest opportunity.
  2. Refunds policy
  • Except where the order is cancelled according to the procedure outlined in sections 4 and 5 above, York Christmas trees does not offer refunds for goods purchased.
  1. Where York Christmas Trees agree that goods are not fit for purpose, we will offer the customer an exchange product to the same value as that originally purchase. We retain the right to determine the suitability of the product and the right to issue a refund is at our discretion.

 

  1. Force Majeure
  • Neither York Christmas Trees nor our chosen courier or delivery service provider can be held responsible for delays in delivery due to events beyond our control.
